Pickup Supper is a pickup-only ordering app. You order ahead from a local restaurant or food truck, you drive there, and you pick it up. There is no delivery. We never cook, handle, or carry your food.
You pay the menu price plus sales tax. We add no fees to your order. The restaurants pay us, not you.
Pickup Supper is operated by Pickup Supper LLC, a North Carolina limited liability company (“Pickup Supper,” “we,” “us,” or “our”). These Terms of Service (“Terms”) are a binding agreement between you and Pickup Supper LLC. They cover your use of the Pickup Supper mobile apps, our website at pickupsupper.com, and any related services (together, the “Service”).
By creating an account, placing an order, or otherwise using the Service, you agree to these Terms and to our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, do not use the Service.
These Terms apply to customers. Restaurants and food trucks that sell through Pickup Supper are governed by a separate written agreement with us, not by these Terms.
You may use the Service only if you can form a binding contract with us and are not barred from doing so under applicable law.
Pickup Supper does not sell alcohol and does not list alcoholic beverages for sale. You may use one account per person, and you must provide accurate information when you register.
We are a marketplace. We provide technology that lets you browse a local restaurant’s menu, send your order to that restaurant, pay for it, and get told when it is ready. That is the whole of what we do.
When you place an order, you are buying food from the restaurant. The restaurant is the seller. The restaurant sets its own menu, prices, hours, portion sizes, ingredients, and packaging. The restaurant prepares your food, bags it, and hands it to you. The restaurant is the merchant of record for your payment, which is why your card or bank statement will show the restaurant’s name, not ours.
We do not:
Restaurants on Pickup Supper are independent businesses. They are not our agents, partners, employees, or joint venturers, and we are not responsible for their acts or omissions. Nothing in these Terms creates any agency, partnership, employment, or joint venture relationship between us and any restaurant or between us and you.
Curbside. Where a restaurant offers curbside pickup, the restaurant’s own staff bring your order out to your vehicle. No Pickup Supper personnel are involved.
To order, you create an account with your name, a mobile phone number, and an email address. You are responsible for keeping your login credentials and your device secure, and for all activity under your account. Tell us promptly at support@pickupsupper.com if you believe your account has been used without your permission.
Keep your information current. If your mobile number changes, update it in the app or remove it. This matters: if you keep an old number on your account, order notifications may go to whoever holds that number next. See Section 12.
When you submit an order, you are making an offer to buy the listed items from the restaurant at the listed prices. Your order is not a completed sale until the restaurant accepts it.
Restaurants are expected to accept or decline each order within seven minutes during their posted Pickup Supper order hours. If nothing happens by ten minutes, we will ask you whether you want to keep waiting or cancel. If you cancel, the authorization on your card is released and no money moves. See Section 7 and Section 10.
A restaurant may decline an order for legitimate reasons, including that it is unexpectedly closed, out of an item, too backed up to cook it on time, or unable to fulfill a special request. Ready times shown in the app are the restaurant’s good-faith estimates and are not guarantees.
Pickup orders are prepared to be picked up promptly. Food left uncollected is the customer’s responsibility, and neither we nor the restaurant are obligated to remake or refund an order you did not come get.
You pay the restaurant’s menu price for each item, plus applicable North Carolina and local sales tax, plus any tip you choose to add. Nothing else. Pickup Supper charges customers no service fee, no platform fee, no convenience fee, no delivery fee, no small-order fee, and no markup. Your itemized receipt shows a service fee line of $0.00 because that is what it is.
We require every restaurant on Pickup Supper to list items at the same price it charges for that item on its own menu. If you ever believe you were charged more through Pickup Supper than the restaurant’s own menu price, tell us at support@pickupsupper.com and we will look into it. Menu prices, availability, and item descriptions are supplied and maintained by the restaurant, and occasional errors or stale entries can happen.
Pickup Supper collects and remits North Carolina sales and use tax on orders placed through the Service in its capacity as a marketplace facilitator under North Carolina law, including N.C. Gen. Stat. §§ 105-164.3 and 105-164.4J. Sales tax is shown as its own line on your receipt.
We email an itemized receipt for every completed order. It shows each item, sales tax on its own line, any tip, a $0.00 service fee line, and a note that your card statement will show the restaurant’s name.
Payments are processed by Stripe. Your full card number never reaches Pickup Supper’s systems; we store only a token that lets Stripe charge the card you selected. Your use of payment features is also subject to Stripe’s terms and privacy policy.
At checkout, we place an authorization hold on your card for the order total. Your card is actually charged when the restaurant marks your food ready.
If the restaurant declines your order, never responds, or your order is canceled before your food is marked ready, the authorization is released and no charge is ever made. This is not a refund, because no money was taken. Depending on your bank, a released authorization can take a few business days to disappear from your pending transactions. That timing is your bank’s, not ours.
You authorize us and the restaurant, through Stripe, to charge your selected payment method for the order total once the restaurant marks your food ready. If your payment method is declined, the order does not go through.
Refunds are issued to the original payment method. We do not offer cash refunds or store credit.
Tipping is entirely optional and defaults to nothing. One hundred percent of any tip you add goes to the restaurant. Pickup Supper takes no portion of any tip, ever. Tips are routed through Stripe with the rest of your payment. How a restaurant distributes tips among its staff is up to that restaurant.
You are responsible for going to the correct location during the restaurant’s Pickup Supper order hours and collecting your order. Bring your order number. The restaurant may ask you to confirm your name or order number before handing over food.
If a restaurant offers curbside, you tell the app you have arrived and provide vehicle details so staff can find you. Park legally and safely, follow the restaurant’s posted instructions, and do not operate the app while driving. Curbside is provided by the restaurant’s staff, and its availability and speed are the restaurant’s.
A group order lets several people each build their own order on their own phone against one pickup. Each person’s food goes in one labeled bag for that person. Depending on the mode the group uses, either each person pays for their own items or one person pays for everything. Whoever pays is responsible for what they pay for. If you organize a group order, you are responsible for collecting the bags and for whatever payment method you attached to the order. We are not responsible for sorting out money between members of a group.
If you share a group order link, anyone with that link can add items to the order. Share it only with people you intend to feed.
We hold restaurants to written performance standards and we tell you what is happening rather than leaving you guessing.
None of this makes us the seller of your food, and none of it is a guarantee about any individual order.
FOOD SOLD THROUGH PICKUP SUPPER IS PREPARED IN RESTAURANT AND FOOD TRUCK KITCHENS THAT HANDLE MAJOR FOOD ALLERGENS, INCLUDING MILK, EGGS, FISH, SHELLFISH, TREE NUTS, PEANUTS, WHEAT, SOYBEANS, AND SESAME. ANY ITEM MAY CONTAIN OR HAVE COME INTO CONTACT WITH ANY ALLERGEN, WHETHER OR NOT THE MENU SAYS SO. CROSS-CONTACT IS POSSIBLE ON ANY ORDER.
PICKUP SUPPER DOES NOT PREPARE FOOD AND CANNOT AND DOES NOT VERIFY INGREDIENTS, PREPARATION METHODS, OR ALLERGEN CONTROLS AT ANY RESTAURANT. IF YOU HAVE A FOOD ALLERGY, INTOLERANCE, SENSITIVITY, RELIGIOUS OR MEDICAL DIETARY RESTRICTION, OR ANY OTHER CONDITION THAT MAKES WHAT IS IN YOUR FOOD IMPORTANT, CONTACT THE RESTAURANT DIRECTLY BEFORE YOU ORDER AND CONFIRM DIRECTLY WITH THE RESTAURANT WHEN YOU PICK UP. DO NOT RELY ON THE APP, ON AN ORDER NOTE, OR ON A MENU DESCRIPTION.
Menu descriptions, ingredient lists, nutrition information, and any allergen notes in the app are supplied by the restaurant, not by us. We pass them along as given. Notes you add to an order are requests to the restaurant, and neither we nor the restaurant guarantee that any note will be seen, honored, or acted on.
Some restaurants choose to add their own allergen information to their Pickup Supper page. That information is theirs. Its accuracy is their responsibility.
Once you pick up your food, keeping it at a safe temperature and eating it in a reasonable time is up to you.
This section explains our messaging program in plain terms. Please read it in full.
Our first choice is always a push notification to your phone. We send an SMS text message to the mobile number on your account only if you have turned push notifications off or said no to them, so you do not miss food you already paid for.
By creating an account and providing your mobile phone number, you agree that Pickup Supper LLC may send you automated text messages about your orders at the number you provided, using an automatic telephone dialing system or other automated technology.
These messages are about your own orders only. They are limited to:
Message frequency: varies, and depends entirely on how often you order. A typical order generates two to four messages. You receive no order messages when you do not order.
Message and data rates may apply. Your mobile carrier’s rates apply to messages you send and receive. Carriers are not liable for delayed or undelivered messages.
Consent to receive order messages is not a condition of any purchase. You can order and receive push notifications only.
To stop: reply STOP to any message. You can also reply UNSUBSCRIBE, CANCEL, END, or QUIT. You will get one confirmation message and then nothing further. For help: reply HELP or email support@pickupsupper.com.
Supported carriers include AT&T, Verizon Wireless, T-Mobile, Sprint, Boost, U.S. Cellular, MetroPCS, Cricket, and Google Fi, among others. Service may not be available on all carriers.
If you reply STOP, we stop texting you. We will still email you receipts and still send push notifications if they are enabled, because those are how you learn your food is ready. Turning off text messages may mean you miss an order notification. That is your choice to make.
We will not send you marketing or promotional text messages unless you separately and affirmatively opt in to them. Your consent to order messages under Section 12.2 is not consent to marketing messages, and we do not treat it as such.
If you choose to opt in to a promotional program such as Today’s Specials, you will check a separate, unchecked box that appears next to language telling you what you are agreeing to. By checking it, you provide your prior express written consent to receive automated marketing text messages from Pickup Supper LLC at the mobile number on your account, sent using an automatic telephone dialing system.
We keep a record of when, where, and how you gave this consent.
The app has a notification settings screen where you can switch individual categories on or off — order updates, ready alerts, promotions — without turning everything off. You can also turn off push notifications entirely in your phone’s settings, reply STOP to any text, or remove your mobile number from your account. If you delete your account, we stop all messages.
You represent that the mobile number you give us is your own number and that you are the person who normally uses it, or that you have the authority of the person who does. You agree to update or remove the number in the app if it stops being yours. If you give us a number that is not yours, or fail to update a number you have given up, you agree to indemnify us for claims arising from messages sent to that number, to the extent permitted by law. We are not responsible for messages delivered to a number you told us was yours.
Restaurants never receive your phone number or your email address. A restaurant sees your first name for the bag label, the order itself, and — on a curbside order — your vehicle details. Nothing more.
We do not sell, rent, or share your mobile phone number or your SMS opt-in information with third parties or affiliates for their own marketing purposes. Your number is shared only with the vendors that make the messages work, such as our SMS provider, and only so they can deliver our messages to you. See our Privacy Policy.
Ratings. After an order you can leave a one-tap star rating. Ratings can only be left on orders you actually placed and picked up.
Requesting a restaurant. You can suggest a restaurant or food truck you would like to see on Pickup Supper, and others can vote for it. These suggestions are public. Submit the name of a business, not commentary about people. We may edit or remove any submission.
Your content. Ratings, requests, order notes, and anything else you submit are “User Content.” You keep whatever rights you have in it, and you grant us a non-exclusive, worldwide, royalty-free, sublicensable, transferable license to host, store, reproduce, display, and use it to operate and promote the Service. You confirm you have the right to submit it and that it is not unlawful, defamatory, fraudulent, or infringing. We may remove User Content at our discretion and are not obligated to keep or display anything.
We may suspend or terminate your access for any violation of this section, with or without notice.
The Service, including its software, design, text, graphics, and the Pickup Supper name and logo, is owned by Pickup Supper LLC and protected by intellectual property law. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service to order food for yourself. We reserve all other rights. You may not use our name or logo without our written permission.
Restaurant names, logos, menus, and photographs belong to those restaurants and appear with their permission.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, PICKUP SUPPER LLC DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; THAT NOTIFICATIONS OR TEXT MESSAGES WILL BE DELIVERED OR DELIVERED ON TIME; THAT ANY RESTAURANT WILL ACCEPT, PREPARE, OR HAVE READY ANY ORDER; OR THAT MENU, PRICE, HOURS, INGREDIENT, OR ALLERGEN INFORMATION SUPPLIED BY A RESTAURANT IS ACCURATE OR COMPLETE.
WE MAKE NO WARRANTY OF ANY KIND REGARDING THE FOOD ITSELF — ITS QUALITY, SAFETY, TEMPERATURE, PREPARATION, INGREDIENTS, NUTRITIONAL CONTENT, OR FITNESS FOR CONSUMPTION — OR REGARDING ANY RESTAURANT’S CONDUCT, LICENSING, SANITATION, OR COMPLIANCE WITH LAW. THE FOOD IS SOLD TO YOU BY THE RESTAURANT.
Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.
TO THE FULLEST EXTENT PERMITTED BY LAW, PICKUP SUPPER LLC AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL, ARISING OUT OF OR RELATING TO THE SERVICE, WHETHER BASED IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID THROUGH THE SERVICE IN THE SIX MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).
WE ARE NOT LIABLE FOR THE ACTS OR OMISSIONS OF ANY RESTAURANT, INCLUDING ANY ILLNESS, ALLERGIC REACTION, INJURY, OR OTHER HARM ARISING FROM FOOD PREPARED OR SOLD BY A RESTAURANT.
These limits apply even if a remedy fails of its essential purpose. Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for our own gross negligence, willful misconduct, or fraud.
You agree to indemnify, defend, and hold harmless Pickup Supper LLC and its members, managers, officers, employees, and agents from any claim, demand, loss, liability, damage, cost, or expense (including reasonable attorneys’ fees) arising out of or relating to: your use of the Service; your violation of these Terms or of any law; your User Content; a phone number you provided that was not yours or that you failed to update; or your dealings with any restaurant.
This section requires you to resolve most disputes with us through individual binding arbitration rather than in court. It waives your right to a jury trial and your right to participate in a class action. You may opt out of arbitration within 30 days — see Section 19.7.
Before starting arbitration or any other proceeding, you agree to give us a written Notice of Dispute at legal@pickupsupper.com and at our notice address in Section 23. The notice must include your name, the phone number and email on your account, a description of the dispute, the specific relief you want, and the amount. We will do the same for any dispute we have with you. Both sides then have 60 days to try to resolve it informally, and either side may request a telephone settlement conference during that period. This step is a condition of starting arbitration, and the 60 days does not count against any limitations period.
If the 60 days pass without resolution, either side may request non-binding mediation in Haywood County, North Carolina, before a mediator agreed to by both sides, with the mediator’s fees split equally. Mediation is optional for consumer disputes, but we offer it because it is usually the cheapest and fastest way to fix a problem.
Except as stated in Section 19.4, you and Pickup Supper LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Service, any order, any message sent to you, or our relationship — whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory, and whether arising before, during, or after the termination of these Terms — will be resolved by binding individual arbitration and not in a court of law.
The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect, as modified by this section. The rules and forms are at adr.org. The arbitration will be conducted by a single arbitrator. For claims of $25,000 or less, you may choose to proceed by documents only, by telephone or video, or in person. Any in-person hearing will be held in Haywood County, North Carolina, or in the county where you live, at your choice. The arbitrator may award any relief a court could award to you individually, and must follow these Terms. The arbitrator’s decision is final and binding, and judgment on the award may be entered in any court of competent jurisdiction. This agreement to arbitrate is governed by the Federal Arbitration Act.
Fees. We will pay AAA’s filing, administrative, and arbitrator fees for any individual claim you bring for $10,000 or less, unless the arbitrator finds your claim was frivolous or brought for an improper purpose. Above that, fees are allocated under AAA’s rules. Each side otherwise bears its own attorneys’ fees unless a statute or the arbitrator’s award provides otherwise.
Either side may bring an individual claim in small claims court in Haywood County, North Carolina, or in the county where you live, if the claim qualifies and stays in that court on an individual basis. Either side may also seek injunctive relief in court to stop infringement or misuse of intellectual property. Nothing in this section stops you from reporting a concern to a government agency.
YOU AND PICKUP SUPPER LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON’S CLAIMS AND MAY NOT PRESIDE OVER ANY FORM OF CLASS OR REPRESENTATIVE PROCEEDING. YOU AND PICKUP SUPPER LLC ALSO WAIVE ANY RIGHT TO A TRIAL BY JURY.
If this class action waiver is found unenforceable as to a particular claim or request for relief, that claim or request will be severed and heard in a court of competent jurisdiction in Haywood County, North Carolina, and all other claims will remain in arbitration.
If 25 or more similar arbitration demands are filed against us by or with the assistance of the same law firm or coordinated group within a 90-day period, the demands will be administered in sequential batches of no more than 50. The parties will select and arbitrate a first batch as bellwether cases, then attempt global resolution or mediation of the remaining demands before any further batch proceeds. AAA will charge filing and administrative fees on a per-batch rather than per-case basis, and any applicable limitations period is tolled for demands awaiting their batch. This provision is intended to make mass claims workable and affordable for both sides, not to delay any individual claim.
You can reject this arbitration agreement. Email legal@pickupsupper.com within 30 days of first creating your account with the subject line “Arbitration Opt-Out” and include your name and the phone number and email on your account.
If you opt out, Sections 19.3, 19.5, and 19.6 do not apply to you, and disputes go to the state or federal courts located in Haywood County, North Carolina, which you and we agree have exclusive jurisdiction. Sections 19.1 and 19.2 still apply. Opting out has no effect on your account, your prices, or how we treat you, and we will not retaliate for it.
If we materially change Section 19 after you create your account, you may reject the change by emailing legal@pickupsupper.com within 30 days of the change taking effect, in which case the version of Section 19 in effect when you created your account continues to govern.
This Section 19 survives termination of these Terms and deletion of your account.
You can delete your account at any time from inside the app, under account settings. Deleting your account stops all notifications and removes your personal information as described in our Privacy Policy. You can also email support@pickupsupper.com and we will do it for you.
We may suspend or terminate your access at any time if you violate these Terms, if we reasonably suspect fraud or abuse, or if we stop offering the Service. Sections 13 (as to content already submitted), 15, 16, 17, 18, 19, and 22 survive termination.
We may update these Terms. When we make a material change, we will post the updated Terms with a new effective date and notify you in the app, by email, or both, at least 14 days before the change takes effect where practicable. Continuing to use the Service after the effective date means you accept the updated Terms. If you do not accept them, delete your account. Changes to Section 19 are handled under Section 19.8.
Governing law. These Terms and any dispute between us are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws rules, except that the Federal Arbitration Act governs Section 19.
Where we operate. The Service is offered in the United States, and currently in Western North Carolina only. We make no representation that the Service is appropriate or available anywhere else.
Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us about the Service and replace any prior agreements or understandings.
Severability. If any provision is held unenforceable, it will be limited or removed to the minimum extent necessary and the rest stays in force.
No waiver. Our failure to enforce any provision is not a waiver of it.
Assignment. You may not assign these Terms. We may assign them to an affiliate or in connection with a merger, acquisition, reorganization, or sale of all or substantially all of our assets.
Force majeure. Neither we nor any restaurant is liable for failures caused by events beyond reasonable control, including severe weather, power or internet outages, carrier failures, natural disasters, and government action.
Notices. We may send you notices by push notification, text message, email, or in-app message. You send us notices at the addresses in Section 23.
App stores. If you get our app from the Apple App Store or Google Play, these Terms are between you and us, not with Apple or Google. Those companies have no obligation to provide support for the app and are not responsible for it. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
